FanDrive – Terms & Conditions

FanDrive™ and the FanDrive mobile application (the “App”) are owned and operated by Eirvanta LLC, an Illinois limited liability company (“Eirvanta,” “we,” “us,” or “our”), located at:

By accessing or using the App, you (“you,” “user,” or “account holder”) agree to these Terms & Conditions (“Terms”). If you do not agree, do not use FanDrive.

1. About FanDrive

FanDrive is a motorsport engagement platform enabling users to:

• Create and view driver and car profiles
• Scan QR codes on vehicles
• Access race weekend updates
• View stats and session information
• Join or manage teams
• Post images, videos, and updates

FanDrive uses secure backend services hosted on Microsoft Azure.

2. Eligibility

You must:

• Be at least 13 years old (or the minimum legal age in your region),
• Use your own email address for authentication, and
• Have authority to accept these Terms.

If you represent a team or organization, you confirm that you are authorized to act on its behalf.

3. Accounts & Passwordless Email Authentication (“Magic Link Authentication”)

FanDrive uses a passwordless authentication system, where a one-time secure login link is sent to the email address you provide (“Magic Link Authentication”).

By using this system, you agree that:

• Access to your email inbox constitutes proof of identity,
• You are responsible for securing your email account,
• You will notify us immediately if you suspect unauthorized access, and
• We may suspend or restrict your account to maintain security and enforce these Terms.

Eirvanta is not responsible for unauthorized access caused by compromised email accounts.

4. User-Generated Content

Users may upload or publish:

• Photos and videos,
• Car and driver descriptions,
• Team logos and updates,
• Race weekend content, and
• QR-linked materials.

4.1 You Own Your Content

You retain full ownership of content you upload.

4.2 License Granted to Eirvanta

By uploading content, you grant Eirvanta a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to:

• Host, store, reproduce, display, distribute, and transmit your content,
• Modify formatting solely for compatibility with the App, and
• Use public-facing content for promotional purposes.

This license ends when you delete content, except where:

• Others have already accessed or shared it,
• Copies remain in backups for a limited time, or
• Retention is required for legal, security, or record-keeping reasons.

4.3 Prohibited Content

You may not upload content that is:

• Illegal,
• Defamatory, hateful, or discriminatory,
• Violent or threatening,
• Fraudulent or misleading,
• Unsafe or encouraging dangerous conduct,
• Pornographic or explicit,
• Infringing on intellectual property rights, or
• Violating track, venue, or event safety rules.

We may moderate or remove content at our discretion.

5. Motorsport Safety Disclaimer & Assumption of Risk

Motorsport is inherently dangerous. By using FanDrive, you acknowledge that:

5.1 No Safety Guidance

FanDrive does not provide:

• Safety instructions,
• Trackside guidance,
• Emergency information, or
• Racing or performance advice.

Do not rely on the App for any safety-critical purpose.

5.2 Data May Be Inaccurate or Delayed

Race data, positions, timing, posts, and updates may be delayed, incomplete, or incorrect and must not be used for operational or driving decisions.

5.3 Assumption of Risk

You assume all risks associated with attending motorsport events or interacting with race environments.

5.4 Release of Liability

To the fullest extent permitted by law, you release Eirvanta LLC, its officers, employees, and contractors from liability related to:

• Motorsport events or injuries,
• User-generated content,
• Misuse of the App, and
• Inaccurate or delayed data.

6. Third-Party Data and Integrations

FanDrive may ingest data from third parties such as timing services and motorsport organizers. We do not guarantee the accuracy, completeness, or availability of third-party data, which is provided “as is.”

7. Intellectual Property

FanDrive™ is a registered trademark of Eirvanta LLC. The App code, branding, design, and backend systems belong to Eirvanta. You may not copy, reverse-engineer, or modify the App.

User content remains your property, subject to the license you grant under these Terms.

8. QR Codes & Car Profiles

By using QR scanning features, you agree to:

• Scan QR codes only in publicly accessible areas,
• Not tamper with or remove QR codes you do not own, and
• Only generate QR codes for vehicles or teams you represent.

We are not responsible for how third parties use or display QR codes.

9. Teams and Memberships

Team owners may invite members, manage car profiles, and update team information. Eirvanta is not responsible for team disputes, unauthorized changes, or misrepresentations by users.

10. App Updates

Updates may be required for continued functionality. Features may change or be removed at any time.

11. Termination

We may suspend or terminate accounts for:

• Violations of these Terms,
• Unsafe or abusive behavior,
• Fraud or misrepresentation,
• Intellectual property infringement, or
• Actions creating legal or safety risks.

You may delete your account at any time.

12. Disclaimers

FanDrive is provided “as is” without warranties of any kind, including fitness for a particular purpose, non-infringement, or the accuracy, reliability, or availability of data. We do not guarantee uninterrupted service.

13. Limitation of Liability

To the fullest extent permitted by law:

• Eirvanta LLC is not liable for indirect, incidental, or consequential damages, and
• Total aggregate liability does not exceed $100 USD.

We are not liable for injuries or incidents at motorsport events.

14. Governing Law

These Terms are governed by the laws of the State of Illinois, USA. You agree to jurisdiction in the courts of Cook County, Illinois.

15. Changes to These Terms

We may update these Terms at any time. Continued use of the App constitutes acceptance of updated Terms.

17. UK Contracting Entity (FanDrive Motorsport Ltd)

In the United Kingdom, certain commercial arrangements, motorsport-related services, and partnership agreements may be conducted through:
